A Case Study of Ethics in Engineering: 
Build It and They Will Come – Build It Wrong and They Will Sue

Ethics is the underpinning of many professions, particularly those with licenses, like engineers. This presentation will focus on the ethical obligations of engineering professionals, with an emphasis on general principles of ethics, conflicts of interest, timely disclosures, and distinctions for those who work for public municipal entities. Notable matters, including the Boeing 737 investigation, Fiat-Chrysler litigation, and the VW emissions case, will be examined. These cases will illustrate the importance of maintaining ethics in practice and the implications when ethical duties are breached.

Presenter: Henry A. Zomerfeld, Senior Associate, Hodgson Russ LLP
Henry A. Zomerfeld is a senior associate at Hodgson Russ LLP and is based in the firm’s Buffalo, New York office. Henry concentrates his practice in environmental, energy, land use, and municipal law. As part of his practice, Henry works with various engineers (civil, structural, geo-technical) both for his client and on the other side of zoning applications and litigation matters. He presented in January of 2024 for the Niagara Frontier chapter of A&WMA on ethics for public and private engineers in New York State.

Moderator: Jason Midgett, Environmental Engineer, Placid Refining Company, LLC
Jason Midgett is an Environmental Engineer for Placid Refining Company LLC in Port Allen, Louisiana. He is responsible for developing and managing regulatory compliance programs at the independently owned petroleum refinery. He is
an active member of Air and Waste Management Association working on the Associations webinar committee for the last several years. Midgett holds bachelor and master’s degrees in Biological Engineering from Louisiana State University.
